Booking Conditions
Aardvark Safaris Limited
Aspire Business Centre, Ordnance Road, Tidworth, Hampshire SP9 7QD | Company No. 03800138 | ATOL 5356
The following booking conditions, together with our privacy policy and any written information provided to you before your booking was confirmed, set out the terms of your contract with Aardvark Safaris Limited (trading as ‘Aardvark Safaris’, and referred to in these conditions as ‘Aardvark’, ‘we’, ‘us’ and ‘our’). Please read them carefully, as they are binding on you and all members of your party. Please detach and keep with your travel documents.
Aardvark Safaris is fully bonded by the Civil Aviation Authority under Air Travel Organiser’s Licence number 5356. ATOL protection primarily extends to customers who book and pay in the UK for flight-inclusive holidays. Non-flight packages are protected through our ABTOT insurance policy. This means you are financially protected in the event we become insolvent.
The combination of travel services offered to you is a package within the meaning of the Package Travel and Linked Travel Arrangements Regulations 2018. Accordingly, you will benefit from all rights applying to packages under UK law. Aardvark Safaris Limited is fully responsible for the proper performance of the package as a whole.
These conditions also apply to the re-booking of a tour by way of a transfer from a previous booking or under a credit note.
Your contract with us comes into effect as soon as we issue a booking confirmation invoice to the party leader. Prior to this, we may send an acknowledgement of your booking request, but this is simply confirmation that we are processing your request and is not a confirmation of the booking.
The party leader must be at least 18 years of age and must be authorised to book on behalf of all members of the party, including all persons under 18 years. By making a booking, the party leader guarantees they have the authority to accept, and do accept, these booking conditions on behalf of the whole party. The contract is governed by English law and the jurisdiction of the English courts, although customers resident in Scotland or Northern Ireland may choose the law and courts of those jurisdictions if they wish.
The party leader is responsible for making all payments due under the booking. All party members are jointly and severally liable for all sums due.
Once you receive your confirmation invoice and any ATOL Certificate, please check everything carefully. If any details are incorrect or incomplete, notify us in writing immediately. We cannot accept liability for inaccuracies not notified to us within 7 days of issue (or immediately for bookings commencing within 7 days).
We reserve the right to refuse a booking in our absolute discretion without giving a reason.
Where flights are requested, it may not always be possible to confirm exact travel arrangements at the time of booking due to airline restrictions. Your confirmation invoice and/or ATOL Certificate will set out the arrangements confirmed or provisionally reserved. Some airlines charge separately for luggage; some flights may be indirect; and timings may be subject to change by the airline. We may not be able to confirm specific seat numbers and reserve the right to make changes, but we will notify you of any such changes as soon as possible.
If you choose to arrange your own international flights (whether on air miles or otherwise), Aardvark Safaris cannot accept liability for any missed onward connections or consequential delays and related costs to your itinerary. We will offer assistance to put alternative arrangements in place, but you are solely liable for any costs.
Suppliers of certain camps and activities in Africa require guests to sign an indemnity waiver. By making your booking, you agree to sign such forms if requested. If you are unwilling to do so, the operator may refuse to allow you to stay or participate. Please contact us before booking if you would like to review the wording of any such waiver.
When you make your booking, a deposit of 30% of the total holiday cost is required, together with any costs that must be paid in full at the time of booking (for example, gorilla permits and certain flight costs, which will be notified to you at the time of booking). Following receipt of your booking request, a provisional booking will be held for 24 hours pending receipt of cleared funds. If payment is not received within 24 hours, the provisional booking will be released.
The balance of your holiday cost must be paid no later than 13 weeks before departure, as shown on your booking confirmation invoice. For bookings made within 13 weeks of departure, the full cost is payable at the time of booking.
If the deposit and/or balance are not paid on time, we reserve the right to cancel your booking. If the balance is not paid on time, we shall retain any deposit paid and cancellation charges as set out in clause 6 will apply.
Payment may be made by bank transfer, debit card or cheque. Where payment is made by cheque, sufficient time must be allowed for the cheque to clear.
All prices shown are per person based on two sharing a twin or double room unless otherwise stated.
It goes without saying that comprehensive travel insurance is essential. You must provide us with the name of your insurer, policy number and 24-hour emergency helpline number no later than 28 days before departure.
Your policy must, at a minimum, cover cancellation, medical expenses, evacuation and repatriation, and all other usual travel risks. It is your responsibility to arrange cover appropriate to your personal requirements. Any pre-existing medical conditions or disabilities must be disclosed to your insurers. Your insurance contract is a separate arrangement between you and your insurers, subject to its own policy conditions.
If you take part in activities arranged independently of Aardvark whilst on tour, it is your responsibility to ensure you have appropriate cover for those activities.
If you have a special request, please advise us at the time of booking. We will pass it on to the relevant supplier, but we cannot guarantee it will be met, and any failure to do so is not a breach of contract. Confirmation that a request has been noted will appear on your booking confirmation. We are unable to accept a booking made conditional upon a special request being fulfilled. Room types and configurations cannot be guaranteed, though requests will always be noted.
If you wish to change your travel arrangements after we have issued a confirmation invoice, we will do our best to assist, though it may not always be possible. All requests must be made in writing by the party leader to Discover@aardvarksafaris.com. An administration charge of £50 per person will apply, plus any additional costs imposed by suppliers or airlines. The price of any changed arrangements will be based on prices prevailing on the date of the change.
If we are unable to assist with a requested change and you do not wish to proceed with your original arrangements, your booking will be treated as a cancellation, and the charges in clause 6 will apply.
If any member of your party is prevented from travelling, they may transfer their place to another person, subject to the following conditions:
• That person must be introduced by you and meet all conditions applicable to the holiday, including visa requirements.
• Written notice of the transfer must be given to us no later than 7 days before departure.
• The outstanding balance, an amendment fee of £50 per person transferring, and any additional charges imposed by suppliers must be paid.
• The transferee must agree to these booking conditions and all terms of the contract.
You and the transferee will remain jointly and severally liable for all sums due. If you cannot find a replacement, cancellation charges in clause 6 will apply. No refunds will be given for unused services.
Please note that airlines may not permit name changes after ticketing, or within certain periods before departure. If a name change is not permitted, it may be necessary to cancel and rebook the flight at full cost, which may differ from the original fare.
If, after the commencement of your holiday, you or any member of your party cuts short or curtails the trip for any reason, we are unable to refund the cost of any unused elements.
Should you wish to cancel your confirmed booking, written notification must be received from the party leader by email to Discover@aardvarksafaris.com. Cancellation takes effect from the date we receive written notice.
Because we incur costs from the moment a booking is confirmed, the following charges will apply:
Period of Notice Before Departure | Cancellation Charge
92 days or more: Loss of deposit plus any additional upfront costs (e.g. gorilla permits, certain flight costs)
91 to 61 days: 60% of the total tour cost (or loss of deposit if greater)
60 days to departure: 100% of the total tour cost
Please note that certain elements — such as flights, gorilla permits and other advance purchases — may be subject to 100% cancellation charges regardless of the period of notice given, in addition to the charges above.
The figures are expressed as percentages of the total holiday cost, excluding insurance premiums and amendment charges. If you have not yet paid the full amount due, any outstanding cancellation charge must be paid within 7 days of the cancellation date. If your cancellation is for a reason covered by your travel insurance policy, you may be able to reclaim these charges, subject to any policy excess.
If any member of the party cancels and you cannot fill their place, you may be required to pay additional supplements (for example, single room supplements), which may increase the per-person cost for those still travelling.
You have the right to cancel without paying a cancellation charge if unavoidable and extraordinary circumstances occur at or in the immediate vicinity of your destination which significantly affect the performance of the package or the transport to it. In such circumstances, we will refund all monies paid, but we will not be liable for additional compensation. This right applies only where the Foreign, Commonwealth and Development Office (FCDO) has issued advice against travel to your destination within 14 days of your departure, and that advice was issued after your booking was confirmed. Advice can change; cancellation without the support of FCDO advice, or due to a disinclination to travel, may result in cancellation charges of up to 100%.
For the purposes of this clause, examples of unavoidable and extraordinary circumstances include warfare, acts of terrorism, serious disease outbreaks, natural disasters, floods, earthquakes or severe weather conditions making it impossible to travel safely to the destination.
In the unlikely event that you have cause for complaint during your holiday, please raise it immediately with Aardvark’s local representative, the camp management or the relevant supplier, so that steps can be taken to put matters right. If the problem cannot be resolved on the spot, please contact us in the UK immediately.
If, on your return, your complaint has not been resolved to your satisfaction, please notify us in writing within 28 days of the end of your holiday, emailing Discover@aardvarksafaris.com with your booking reference and all relevant details. Failure to follow this procedure may deprive us of the opportunity to investigate your complaint properly and could affect your rights under this contract.
Please note that Aardvark Safaris does not currently participate in an approved Alternative Dispute Resolution (ADR) scheme, in accordance with the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015.
Unless otherwise stated, the price quoted for your holiday is fixed once we issue a booking confirmation. Your price will not be increased after that except in exceptional circumstances save for surcharges in accordance with the Package Travel and Linked Travel Arrangements Regulations 2018, as described below.
Changes to the following costs may result in the price of your travel arrangements changing after booking. There will be no change within 20 days of your departure:
• The price of transportation arising from the cost of fuel or other power sources.
• The level of taxes or fees applicable to the tour imposed by third parties not directly involved in the performance of your package, including tourist taxes, conservation or National Park fees, and landing, embarkation or disembarkation charges at ports and airports.
If we do decide we have to increase the cost of your holiday, we will notify you in writing as soon as reasonably practical and identify in detail which element of your holiday price has increased.
If any surcharge means you must pay more than 8% of the total confirmed holiday price (excluding insurance premiums and amendment charges), you may choose to:
• Accept the increase and pay the additional amount;
• Accept a change to an alternative tour of comparable or higher standard (with any price difference refunded if the alternative is cheaper); or
• Cancel your booking and receive a full refund of all monies paid, except for any insurance premiums and amendment charges.
If you decide to cancel on the above grounds, you must do so within 14 days of the date on your revised invoice. Where prices decrease, any reduction will be passed on to you.
We will make every effort to provide your holiday as confirmed. Occasionally, minor changes to your arrangements may be necessary. We will notify you of these before departure, where practicable, but minor changes do not entitle you to cancel without charge or to claim compensation. Minor changes include (but are not limited to) changes to routes, itineraries, transport arrangements or accommodation to an equivalent or higher standard.
If we are constrained before the start of your holiday to alter any main characteristic of your arrangements significantly, we will notify you as soon as possible, and you may then choose to:
• Accept the change — in which case the contract will be varied accordingly;
• Accept comparable alternative arrangements from us if available (if the alternative is of a lower price, we will refund the difference); or
• Cancel your booking and receive a full and prompt refund of all monies paid.
If you accept a change, please advise us within 7 days of being notified. If we do not hear from you within 7 days, we will write to you again. If you fail to respond within a further 7 days, we will cancel your booking and refund all payments.
If we make a significant change or cancel your holiday within 14 weeks of departure for reasons other than force majeure, minimum numbers not being reached, or your non-payment, we will also pay compensation as follows:
Notice Given Before Departure | Compensation Per Adult
71 days or more: £10
70 to 22 days: £20
21 to 15 days: £40
14 days or less: £90
Compensation is paid per adult. Children receive compensation pro rata based on the child’s price against the full adult price shown on the confirmation.
Cancellation may be necessary in exceptional circumstances, and we reserve the right in our absolute discretion to cancel your holiday. If this occurs, you will be offered the choice of:
• A comparable alternative holiday (if available); or
• A full and prompt refund of all monies paid.
We will not cancel your holiday within 10 weeks of departure except where the minimum number of bookings required has not been reached, where you have failed to make payment in full, or in circumstances of force majeure (see clause 11).
Some tours can only operate if there is sufficient demand. If the required minimum number of bookings is not reached, we will notify you as soon as possible and not less than 20 days before your start date (for tours lasting more than 6 days), 7 days before (for tours of 2 to 6 days), or 48 hours before (for trips under 2 days). You will have the choice of an alternative of comparable standard or a full refund. No compensation is payable in these circumstances.
We shall not be liable to pay compensation, and we will accept no liability beyond offering you the options set out in clause 9 above, if we are constrained to alter or cancel your arrangements due to unusual and unforeseeable circumstances beyond our control. These include but are not limited to:
• War, threat of war, riot, civil disturbance or terrorist activity and its consequences;
• Industrial disputes;
• Failure to secure flying rights;
• Natural or nuclear disaster, fire, epidemics, health risks or pandemics;
• Unavoidable and unforeseeable technical problems with transport;
• Closed or congested airports or ports;
• Hurricanes and other actual or potential severe weather conditions; and
• Any other similar events beyond our reasonable control.
For the avoidance of doubt, no compensation is payable where significant changes or cancellations are made more than 14 weeks before departure or where cancellation arises from your failure to comply with these booking conditions.
If we are unable to provide a significant proportion of your booked services after your departure, we will, where possible, make suitable alternative arrangements at no extra charge. Where appropriate in all the circumstances, we will also pay you reasonable compensation. A change of accommodation to an equivalent or higher standard is not regarded as significant.
If your contract with us is not performed or is improperly performed as a result of the actions of a third party unconnected with the provision of tour services, or due to unusual and unforeseeable circumstances beyond our control, and you suffer injury or other material loss, we will offer you such prompt assistance as is reasonable in the circumstances. This may include help with communications and alternative travel arrangements. Where the difficulty arises through your own intentional actions or negligence, we may charge a reasonable fee not exceeding our actual costs. All financial assistance is at our reasonable discretion and requires prompt notification by you.
If you are entitled to have costs met by your travel insurance, or if you recover costs from any third party, you must repay to us any costs and expenses we have incurred in assisting you.
We agree to perform and provide the travel arrangements which make up your booking with reasonable skill and care. If the contract is not performed or is improperly performed by us or any of our suppliers in a way that affects your enjoyment of the holiday, we will pay appropriate compensation unless the failure is due to:
• Your own fault or the fault of another member of your party;
• The actions of a third party unconnected with the provision of travel arrangements, where the failure is unforeseeable or unavoidable;
• Unusual and unforeseeable circumstances beyond our control which could not have been avoided even with all due care; or
• An event which neither our suppliers nor we could have foreseen or forestalled, even with all due care.
Our liability to you, except in cases involving death, personal injury or illness, is limited to a maximum of three times the cost of your booking. Our liability is also limited in accordance with the contractual terms of our suppliers and the following international conventions, which are incorporated into and form part of your contract:
• The Montreal Convention (transport by air)
• The Athens Convention (transport by sea)
• The Berne Convention (transport by rail)
• The Geneva Convention (transport by road)
• The Paris Convention (provision of accommodation)
These conventions may limit or remove the carrier’s or supplier’s liability to you. You should note that carriers also rely on their own conditions of carriage, which may further limit their liability.
If we are found liable for loss of or damage to your luggage or personal possessions (including money), our liability is limited to £1,000 per person, unless a lower limit applies under international convention or other provision of this contract.
We do not accept liability for any loss, damage or expense that we could not have foreseen based on the information you gave us at the time of booking, or which relates to any business loss.
Where we make any payment to you for death, personal injury or illness, you must assign to us or our insurers any rights you may have against any person or organisation responsible, and co-operate fully with us in seeking recovery.
We do not accept responsibility for any services that do not form part of your contract with us, including excursions or activities purchased locally during your tour (see clause 17 below).
We provide financial security for our non-flight package holidays by way of an insurance policy with The Association of Bonded Travel Organisers Trust Limited (ABTOT) under The Package Travel and Linked Travel Arrangements Regulations 2018 for Aardvark Safaris Limited (membership number 5704), and in the event of their insolvency, protection is provided for non-flight packages.
ABTOT cover provides a refund if you have not yet travelled, or repatriation if transportation was included in your package. Please note that bookings made outside the UK are only protected by ABTOT when purchased directly with Aardvark Safaris Ltd.
In the unlikely event that you require assistance whilst abroad due to our financial failure, please call our 24/7 helpline on 01702 811397 and advise that you are a customer of an ABTOT protected travel company.
We hold an ATOL (Air Travel Organiser’s Licence), number 5356, granted by the Civil Aviation Authority (CAA), CAA House, 45–59 Kingsway, London WC2B 6TE. When you purchase an ATOL-protected flight or flight-inclusive holiday, you will receive an ATOL Certificate listing what is financially protected and what to do if things go wrong. The price of ATOL-protected flights includes the ATOL Protection Contribution (APC) of £2.50 per person paid to the CAA. Not all flights will be ATOL-protected; please ask us to confirm the protection applicable to your booking.
When you make a booking with us, you acknowledge that there is an inherent element of risk in any adventure, sport or activity in the outdoors, and particularly in Africa. These risks include the risk of injury or illness in remote places without medical facilities, the ever-present risks posed by the forces of nature and wild animals, and the risk of accidents during travel. You must be fit enough to undertake the holiday and must exercise reasonable care for your own safety and that of other members of your party.
It is your responsibility to ensure you have the fitness levels required for the activities forming part of your holiday. If you have any doubts, please consult your GP before departure. Aardvark and our suppliers retain the right, at any time, to decline to allow you to participate in any activity if, in our reasonable opinion, your participation would be contrary to your own health or safety interests.
You must provide us with full details of any existing medical condition, disability or allergy that may affect your travel arrangements or ability to participate in activities at the time of booking. If, in our reasonable opinion, the arrangements are not suitable for your condition, or you are not travelling with someone who can provide any assistance you may require, we reserve the right to refuse the booking or to cancel it if full details are not provided. Cancellation charges in clause 6 will apply in such circumstances.
Standards of catering and hygiene in African camps are, in general, very high, and accommodation ranges from clean and comfortable to genuinely luxurious. However, Africa does not operate under the same health and safety regulations as the UK, the USA or Europe. Rules around certain facilities and activities are more relaxed, which in most cases enhances the experience. We draw your attention to the following:
• Swimming pools are unlikely to be fenced or to display depth markings.
• Steps and pathways around camps may be uneven, lack handrails and may be unlit after dark.
• Outside South Africa, most camps are not fenced from wildlife; smaller animals, insects and reptiles may enter camp areas, though encounters close to your accommodation are uncommon.
• Game viewing vehicles are unlikely to have seat belts. If you feel uncomfortable with a driver’s speed, please ask them to slow down.
• Lifejackets should always be available, but may not be in the boat you are using. Please ask before setting out.
• Most destinations in Africa do not enable Criminal Records Checks for staff working with children’s programmes.
• Communication facilities are often limited in remote areas. Your mobile telephone is unlikely to work; a satellite phone or radio may be available to staff, but not normally for guest use.
• Most camps carry a full medical emergency kit with trained staff. Emergency medical evacuations are rare, but where necessary, an aircraft (often a dedicated medevac plane) will be summoned to the nearest airstrip.
It is your responsibility to ensure that you and all members of your party hold the correct and valid passports, visas and any other immigration documentation required for all destinations to be visited or transited. Please check requirements with the relevant embassies and/or consulates both before booking and before travel. Some destinations require advance visas that can take several months to obtain. We accept no responsibility if you or any member of your party cannot travel or participate in the tour because of failing to comply with these requirements. Cancellation charges in clause 6 will apply.
It is also your responsibility to check all compulsory and recommended health requirements, including vaccinations, for all destinations to be visited or transited, and to ensure that you hold all required documentation. The costs of obtaining such documentation are your responsibility.
Up-to-date foreign travel advice is provided by the Foreign, Commonwealth and Development Office at www.gov.uk/foreign-travel-advice and www.gov.uk/knowbeforeyougo. We strongly recommend you check this advice regularly, both before and during your trip.
If we are required to reissue lost, destroyed or stolen tickets or documents and agree to do so, any charges incurred will be payable by you.
Excursions, tours or other activities that you book or pay for while on tour do not form part of the travel arrangements provided by Aardvark Safaris. In such cases, your contract is with the operator or provider of the excursion, tour, or activity. We are not responsible for the provision of any such activity, or for anything that may happen during the course of it. These booking conditions do not apply to locally booked excursions or activities.
If any flight you have booked is cancelled or significantly delayed, downgraded or if boarding is denied in circumstances that entitle you to claim compensation under EC Regulation No 261/2004 (as amended by The Passenger Rights and Air Travel Organisers Licensing (Amendment) (EU Exit) Regulations 2019), you must pursue the airline directly for compensation due. Aardvark Safaris has no liability to make any payment to you in relation to the Denied Boarding Regulations. If your airline does not comply with its obligations under these Regulations, you should contact the Civil Aviation Authority on 0330 022 1500 or at www.caa.co.uk.
Unfortunately, transport delays do sometimes occur. Depending on the length of the delay and the circumstances, the carrier concerned should provide refreshments where appropriate. We are generally not in a position to provide assistance in the event of transport delays and cannot accept liability except where expressly stated in these conditions.
In accordance with The Package Travel and Linked Travel Arrangements Regulations 2018, where unavoidable and extraordinary circumstances prevent you from returning to your departure point on the scheduled return date, we will provide necessary accommodation for a period not exceeding 3 nights per person (at a comparable standard to your booked accommodation where possible). This 3-night limitation does not apply to persons with reduced mobility (as defined in Regulation (EC) 1107/2006), pregnant women, unaccompanied minors, or persons requiring specific medical assistance, provided you have notified us of these needs at least 48 hours before original departure.
Unless we have stated that a local service or facility is included in the price of your holiday, you may be asked to pay local charges upon arrival or check-out. Tourist taxes, resort fees and similar charges may be payable directly to your accommodation. We will endeavour to notify you of any known charges of this nature at the time of booking.
Please be aware that accommodation and service standards in your destination country are those applicable locally and will not necessarily reflect UK standards. In much of the developing world, these standards may be lower than those in the UK. In making your booking request, you do so with the understanding and acceptance that local standards, facilities and health and safety requirements may differ from those to which you are accustomed.
The information contained in our website, brochures and other promotional material is, to the best of our knowledge and belief, correct at the time of publication. Occasionally, errors may occur, and information may change. You must therefore check all the details of your proposed travel arrangements at the time of booking.
Most people travel with us for rest, relaxation and discovery. If, in our reasonable opinion or in the reasonable opinion of any airline pilot, camp manager, tour leader or other person in authority, your behaviour is causing or is likely to cause danger, damage to property, or is persistently or materially affecting the enjoyment of others, we reserve the right to terminate your holiday arrangements without refund or compensation. In the event of such termination, we will have no further responsibility for you or any member of your party, including for return travel arrangements.
You are responsible for the behaviour of yourself and all members of your party throughout the trip, and for following all instructions, directions and safety protocols given by us, our representatives and our suppliers.
You accept liability for any loss or damage caused by you or any member of your party during the course of the holiday. Payment for any such loss or damage must be made to the relevant supplier or us as soon as reasonably practicable. You agree to indemnify us in respect of any claim subsequently made against us arising from your actions, including all legal costs.
To process your booking and ensure your arrangements run smoothly, we need to pass the information you provide to relevant suppliers, such as airlines, transfer companies, hotels and camp operators. This information may also be passed to credit checking companies and public authorities (such as customs and immigration) where required by law.
Where your tour involves destinations outside the European Economic Area (EEA), data protection standards in your destination country may differ from those in the UK. We will not pass your information to any person not responsible for a part of your travel arrangements. By making this booking, you consent to your information being passed to relevant suppliers.
By making a booking, you consent to your insurers, their agents and medical staff disclosing relevant information to us where we need to act in the interests of all members of your travelling group.
You are entitled to a copy of the information we hold about you; please contact us in writing to request it. An administration charge may apply. Please also refer to our Privacy Policy, which forms part of these booking conditions.
As required by law, Aardvark Safaris Limited has protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that it becomes insolvent. A summary of your key rights is set out below:
• Travellers will receive all essential information about the package before concluding the contract.
• There is always at least one trader liable for the proper performance of all travel services included in the contract.
• An emergency telephone number or contact point for the organiser will be provided.
• Travellers may transfer the package to another person with reasonable notice and may be subject to additional costs.
• The price of the package may only be increased if specific costs rise (for instance, fuel prices) and only if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8% of the package price, the traveller may terminate the contract. If the organiser reserves the right to increase the price, the traveller has the right to a price reduction if there is a decrease in the relevant costs.
• Travellers may terminate the contract without paying any termination fee and receive a full refund if any essential element of the package (other than the price) is changed significantly.
• If the organiser cancels the package before the start date, travellers are entitled to a full refund and, where appropriate, compensation.
• Travellers may terminate the contract without a fee before the start date in exceptional circumstances — for example, if there are serious security problems at the destination likely to affect the package.
• Additionally, travellers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination fee.
• If, after the start of the package, significant elements cannot be provided as agreed, suitable alternative arrangements must be offered at no extra cost. Where services are not performed in accordance with the contract, and this substantially affects performance, and the organiser fails to remedy the problem, travellers may terminate the contract without fee.
• Travellers are also entitled to a price reduction and/or compensation for damages where travel services are not performed or are improperly performed.
• The organiser has to provide assistance if the traveller is in difficulty.
• If the organiser becomes insolvent, payments will be refunded. If insolvency occurs after the start of the package and transport is included, repatriation is secured.
